Agreement between You and Paul’s Pupil
The www.paulspupil.com website (the "Site") is comprised of various web pages operated by Paul’s Pupil. The Site is offered to you (“User” and “Student”) conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.paulspupil.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.
Electronic Communications
Visiting www.paulspupil.com or sending emails to Paul’s Pupil constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
It is the users responsibility to check email regularly for communications from Paul’s Pupil. In the event the user does not respond to a time sensitive email, the user will be held solely responsible for any potential ramifications and/or losses.
Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Paul’s Pupil is not responsible for third party access to your account that results from theft or misappropriation of your account. Paul’s Pupil and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.
User Generated Contributions
The Site may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions").
Contributions may be viewable by other users of the Site and through third-party websites. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contributions, you thereby represent and warrant that:

your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.

your Contributions do not otherwise violate, or link to material that violates, any provision of these Terms and Conditions, or any applicable law or regulation.
Any use of the Site in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site.
Contribution License
By posting your Contributions to any part of the Site [or making Contributions accessible to the Site by linking your account from the Site to any of your social networking accounts], you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sublicenses of the foregoing. This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.
We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site.
You are solely responsible for your Contributions to the Site and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.
We have the right, in our sole and absolute discretion, (1) to edit, redact, or otherwise change any Contributions; (2) to re-categorize any Contributions to place them in more appropriate locations on the Site; and (3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.
Your Feedback to Us
You assign all rights, title and interest in any Feedback you provide Paul’s Pupil. If for any reason such assignment is ineffective, you agree to grant Paul’s Pupil a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.
Children Under Thirteen
Paul’s Pupil does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.paulspupil.com only with the permission of a parent or guardian.
Cancellation/Refund Policy
Paul’s Pupil does not provide refunds or cancellations for courses, products, or services sold through its website. Once payment has been received for courses, products, or services, the transaction is considered final by Paul’s Pupil.
Paul’s Pupil reserves the right to change its payment procedures at any time without prior notice to you.

Paul’s Pupil is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Paul’s Pupil of the site or any association with its operators.
Certain services made available via www.paulspupil.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the www.paulspupil.com domain, you hereby acknowledge and consent that Paul’s Pupil may share such information and data with any third party with whom Paul’s Pupil has a contractual relationship to provide the requested product, service or functionality on behalf of www.paulspupil.com users and customers.
No Unlawful or Prohibited Use/Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use www.paulspupil.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to Paul’s Pupil that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Paul’s Pupil or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. Paul’s Pupil content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Paul’s Pupil and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Paul’s Pupil or our licensors except as expressly authorized by these Terms.
Third Party Accounts
You may be able to connect your Paul’s Pupil account to third party accounts. By connecting your Paul’s Pupil account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.
International Users
The Service is controlled, operated and administered by Paul’s Pupil from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Paul’s Pupil content accessed through www.paulspupil.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
Indemnification
You agree to indemnify, defend and hold harmless Paul’s Pupil, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Paul’s Pupil reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Paul’s Pupil in asserting any available defenses.
Arbitration
In the event, the parties are not able to resolve any dispute between them by informal negotiation arising out of or concerning these Terms of Use, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms of Use or any disputes arising as a result of these Terms of Use, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms of Use.
Class Action Waiver
Any arbitration under these Terms of Use will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Paul’s Pupil agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
Liability Disclaimer
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. PAUL’S PUPIL AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
PAUL’S PUPIL AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. PAUL’S PUPIL AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAUL’S PUPIL AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF PAUL’S PUPIL OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
No Waiver
In the event that Paul’s Pupil fails to enforce any provision of this Agreement, this shall not constitute a waiver of any future enforcement of that provision or of any other provision. Waiver of any part or sub-part of this Agreement will not constitute a waiver of any other part or sub-part.
Termination/Access Restriction
Paul’s Pupil reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington and you hereby consent to the exclusive jurisdiction and venue of courts in Washington in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Paul’s Pupil as a result of this agreement or use of the Site. Paul’s Pupil performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Paul’s Pupil right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Paul’s Pupil with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Paul’s Pupil with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Paul’s Pupil with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Payment for Courses
Users pay for courses through the Paul’s Pupil website (www.paulspupil.com). All payments are processed on the website. Once payment is received, the sale is considered final. Users are entitled to the duration of the course they purchased.
Paul’s Pupil Services, Courses, and Accreditation
Paul’s Pupil services and courses, which are non-licensed and non-accredited, are for your personal, noncommercial use and are intended to be for informational and entertainment purposes only. They are not meant to constitute professional, legal, financial, healthcare, or medical advice or diagnosis.
The student’s acquisition of knowledge and their advancement academically is their sole responsibility; Paul’s Pupil will not be held liable for their lack of progress.
Certificate of Completion
Completing each course’s final essay, along with all other assignments in the course, and having an overall course grade of 80% is required to earn a certificate signifying satisfactory completion of the course. Essays will be reviewed in the order they are received, and if the student has satisfactorily met the minimum 80% for all assignments completed, certification of course completion will be sent to the email address on record. This means that the timeframe for review and emailing of certificates may vary. The final essay is graded as complete or incomplete. The grading rubric in the course indicates what is considered a satisfactory completed final essay. In the event, a student receives an incomplete they may resubmit their Final Essay for regrading within one month (30 days) of the first submission.
Subscription Period
The Service or Site or some parts of the Service or Site are available only with a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as daily, weekly, monthly, or annually), depending on the type of Subscription plan you select when purchasing the Subscription.
At the end of each period, your Subscription will automatically renew under the exact same conditions unless you cancel it or Paul's Pupil cancels it.
Subscription Cancellations
You may cancel your Subscription renewal through your Account settings page. You will not receive a refund for the fees you already paid for your current Subscription period, and you will be able to access the Service until the end of your current Subscription period.
Technical Considerations
Paul’s Pupil recommends that students use the latest software, hardware, and fastest internet speed to access courses and perform academic work. The student is solely responsible for acquiring and maintaining all of the software, hardware, and internet connection they need to access courses and perform academic assignments.
It is the student's responsibility to make sure that hardware and software are installed and up-to-date on their computer or device.
User/Student Behavior
All students are expected to behave in a decent and appropriate manner at Paul’s Pupil. Though in the event behavior and/or language from the student becomes indecent or inappropriate as determined solely at Paul’s Pupil’s discretion, Paul’s Pupil reserves the right to terminate the student's enrollment/account, and the student will also forfeit the remainder of the course or services and monies paid for them. There will be no refund, and the decision by Paul’s Pupil to terminate student enrollment/account will be final.
Termination of Study at Paul’s Pupil
In the event a user would like to end their time of study at Paul’s Pupil, the best time would be once they have completed the course they purchased. However, if a user needs to end their studies with Paul’s Pupil prior to having completed their course(s), they may discontinue at any time, though they will forfeit the remainder of the course(s) or services and all monies paid for them. There will be no refund.
Paul’s Pupil may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service.
Translation Interpretation
These Terms and Conditions may have been translated if Paul’s Pupil has made them available to you on our service. You agree that the original English text shall prevail in the case of a dispute.
Changes to Terms
Paul’s Pupil reserves the right, in its sole discretion, to change the Terms under which www.paulspupil.com is offered. The most current version of the Terms will supersede all previous versions. Paul’s Pupil encourages you to periodically review the Terms to stay informed of our updates.
